The purpose of these Website Terms and Conditions is to advise you about the terms and conditions associated with use of the Telecommunications Industry Association website and the TIA NOW website (collectively the “TIA websites”). The TIA websites are owned by the Telecommunications Industry Association (TIA), doing business as TIA, Telecommunications Industry Association, or TIA NOW.  By using the TIA websites, you agree to these terms and conditions of use, all policies regarding materials and content on the websites, and all laws and regulations that apply to the websites. If you do not agree, please do not use the TIA websites. TIA reserves the right to change, modify, add or remove provisions in these terms and conditions at any time without notice to you. Please check this page every time you use our websites as you are bound by and agree to the posted terms and conditions.

These Website Terms and Conditions complement the Antitrust Policy and Privacy Policy that also apply to all users of these websites which are herein incorporated by reference.  Please refer to the TIA Intellectual Property Rights Policy (IPR Policy) and the Guidelines to the TIA Intellectual Rights Policy relating to the development of standards and other deliverables by TIA Engineering Committees and related entities.

Ownership of Intellectual Property

TIA owns, licenses or uses with permission all content on the TIA websites, including but not limited to registered and unregistered trademarks and service marks, software, information, designs, graphics, audio and video clips, publications, presentations, and other materials, as well as the websites’ format and design. Your unauthorized use of content may violate copyright, trademark, privacy or other laws, and may infringe on the rights of TIA or third parties not owned by or affiliated with TIA.  You are granted a limited license to use the TIA websites and to download contents for your personal, noncommercial use only, but you may not change any copy or other intellectual property notices that accompany the content. Other than as expressly permitted above, including but not limited to use of materials relating to the development of standards and other deliverables by TIA Engineering Committees and related entities, you may not alter, copy, reproduce, distribute, modify or otherwise use or exploit content on the TIA websites. You agree to comply with all intellectual property rights laws.

The TIA websites may contain links to other websites that may not be under the control of TIA. TIA provides these links for your convenience and in no way endorses or promotes the content, products, or operators of these third party websites.  The TIA websites may contain content and material owned by third parties or advertisements for events or content owned by third parties.  TIA in no way endorses or promotes the content, products or operators of events, content or material owned by third parties.  TIA does not warrant the accuracy or reliability of any third party links, events, content or material, or assume any liability from your use of or reliability on third party links, events, content or material.

Disclaimers and Liability

The TIA websites, and the content and services provided on them, are provided “as is,” without any warranties, express or implied, including but not limited to fitness for a particular use or purpose, merchantability, or non-infringement on third party rights. TIA and its suppliers, agents, affiliates, officers, employees and Board of Directors do not assert or warrant their accuracy, reliability, accuracy, completeness, timeliness or other usefulness. You use the TIA websites at your own risk. TIA, its employees, officers, directors, members or agents are not be responsible for any damages of any nature, direct or indirect, relating to your use of the TIA websites in any respect.  You agree to indemnify and hold harmless TIA and its suppliers, agents, affiliates, officers, employees and Board of Directors from and against all claims, damages, and liabilities of any nature from your use of the TIA websites.

Copyright Infringement

If you believe a third party has infringed your copyright in a work, please send TIA written notice of the claimed infringement (membership@tiaonline.org) and TIA will respond. The notice must comply with requirements in the U.S. Digital Millennium Copyright Act, Section 512 ( c ) (3) and include this information: 

(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
(ii)Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
(iii)Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
(iv)Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
(v)A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(vi)A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
